Terms and conditions for purchase of bullion
1. General
1.1 Customer eligibility
- Customers (Customers) may purchase Bullion Products offered for sale by The Perth Mint in accordance with these Terms and Conditions (Terms).
- Customers must be at least 18 years of age and have the legal capacity to enter into a binding contract.
1.2 Applicable law
- These Terms are subject to all applicable laws, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL).
- Nothing in these Terms excludes, restricts or modifies any statutory rights or remedies that cannot lawfully be excluded, restricted or modified.
- Without limiting clause 1.2(b), if the Customer is a “consumer” for the purposes of the ACL, Bullion Products may come with consumer guarantees that cannot be excluded. Where such a guarantee applies, The Perth Mint’s liability is limited, to the maximum extent permitted by law, to the resupply or replacement of the relevant Bullion Products or the cost of such resupply or replacement, at The Perth Mint’s election.
1.3 Definitions
- In these Terms:
- Bullion Products means any bullion product including bullion coins, bullion cast bars, and bullion minted bars in gold, silver or platinum made available for purchase by The Perth Mint.
- Business Day means a day other than a Saturday, Sunday or public holiday in Western Australia.
- Cleared Funds means funds received by The Perth Mint for the purchase of the Products that are not subject to reversal, chargeback, recall, dishonour or restriction.
- The Perth Mint means Gold Corporation (ABN 98 838 298 431) of 310 Hay Street, East Perth, WA 6004, a statutory authority of the Government of Western Australia established under the Gold Corporation Act 1987 (WA), trading as The Perth Mint.
- Website means The Perth Mint website at www.perthmint.com.
- Other terms defined throughout these Terms are shown in bold and capitalised.
2. Purchase methods and order placement
2.1 Purchase methods
- The Customer may place an order for Bullion Products using one of the following methods (each a Purchase Method):
- online via the Website (an Online Order);
- by telephone on:
(a Telephone Order); or
- over-the-counter at The Perth Mint Shop at 310 Hay Street, East Perth WA 6004

- The Perth Mint may impose or vary purchase limits, quantity limits or transaction limits at its discretion, including for operational, regulatory or security reasons.
- The Perth Mint does not permit third parties to place orders on behalf of Customers for the purpose of drop shipping or onward supply to end customers, nor does it permit orders to be placed using automated purchasing tools, bulk purchasing systems or other methods that may disrupt the normal operation of the Website or systems. Where The Perth Mint reasonably suspects such activity, it may decline or cancel the order and refund amounts paid.
2.2 General order requirements (all purchase methods)
- The Customer must ensure that all information provided in connection with an order is accurate, complete and up to date, including the delivery address, contact details, business name (if applicable) and any account or identification details required by The Perth Mint.
- The Perth Mint may decline or cancel an order at any time, acting reasonably and in good faith, including where:
- Bullion Products are unavailable or subject to supply, allocation or production constraints;
- payment cannot be verified or is not received within required timeframes;
- Customer identification or verification requirements are not satisfied;
- the order appears fraudulent or unauthorised;
- The Perth Mint elects to do so due to a material error referred to in clause 2.2(c); or
- completion would expose The Perth Mint to unacceptable risk.
- Without limiting the foregoing, if The Perth Mint identifies an obvious and material error in price, product description, precious metal content, tax, shipping or availability information, or if the Bullion Products are subject to a recall, withdrawal, or regulatory restriction, The Perth Mint may, acting reasonably:
- cancel the affected order or item and refund amounts paid; or
- contact the Customer to reconfirm the order at the correct details.
- The Customer acknowledges that Bullion Products described on the Website or in ordering materials by reference to a year-date may not necessarily indicate the year of release or the year of minting.
- All orders are subject to availability and final acceptance by The Perth Mint in accordance with these Terms.
2.3 Online order and telephone order details
- Upon receipt of a Telephone Order or Online Order, The Perth Mint will issue an email to the Customer confirming that the order has been received (Order Receipt). The Order Receipt is a notification of receipt only and does not constitute acceptance of the order, availability or dispatch.
- The Order Receipt will include the following information (to the extent applicable to the relevant Purchase Method):
- the order reference number;
- order date;
- the list of Bullion Products ordered and their stated prices at the time of order placement;
- the total Bullion Product price and any quoted shipping charges; and
- the selected payment method or payment instructions.
- Once an Online Order or Telephone Order has been reviewed and accepted by The Perth Mint, The Perth Mint will issue an email confirming acceptance of the order (an Order Confirmation) to the Customer. A binding contract for the supply of the relevant Bullion Product(s) is formed only when the Order Confirmation is issued.
- The Order Confirmation may include a payment request setting out confirmed order details, delivery address and payment instructions. The Order Confirmation will not include applicable overseas customs duties, foreign taxes, additional clearance fees or bank charges, all of which are solely the responsibility of the Customer.
- The Customer must promptly review the Order Receipt and Order Confirmation and notify The Perth Mint immediately if any details are incorrect or incomplete. The Perth Mint is not responsible for delays, additional costs or delivery issues arising from incorrect or incomplete information supplied by the Customer, or if the Customer fails to promptly notify The Perth Mint of any discrepancy.
2.4 In-store order details
- For an In-Store Order, a binding contract for the supply of the relevant Bullion Product(s) is formed at the time the Customer completes the purchase at the point of sale, and The Perth Mint issues a Tax Invoice.
- The Tax Invoice issued in accordance with clause 2.4(a) will include the following information:
- the invoice number;
- invoice date;
- the list of Bullion Products purchased and their stated prices at the time of order placement; and
- the total price of the order.
3. Customer account and identification
3.1 Account requirements
- To purchase Bullion Products from The Perth Mint, the Customer must create and maintain a valid customer account in the relevant Purchase Method channel (each, an Account) if required pursuant to these Terms.
- The Perth Mint may require separate Accounts for different Purchase Methods. Accounts are not interchangeable across Purchase Methods.
- The Customer must ensure all Account details are true, accurate and consistent with the Customer’s identification documents and any nominated bank account or payment details.
- The Perth Mint may refuse, delay or restrict the creation, activation or use of an Account where information provided is incomplete, inconsistent or cannot be verified.
- The Customer is responsible for maintaining the confidentiality of any login credentials and for all activities conducted through the Customer’s Account.
3.2 Transactions below AUD 5,000
- Subject to clause 3.4 and clause 3.5, a Customer may place an order with a total transaction value below AUD 5,000 without completing full identity verification.
- For an Online Order or Telephone Order below AUD 5,000, the Customer must hold a valid online Account and provide accurate Account holder details including:
- the Customer’s full name;
- residential address;
- date of birth; and
- contact details (including phone number and email address).
- For an In-Store Order below AUD 5,000, the Customer must, at a minimum, provide:
- the Customer’s full name;
- date of birth;
- phone number and email address; and
- an original current photographic identification document for inspection.
- Multiple transactions that appear to be linked, related or part of a series will be treated by The Perth Mint as a single transaction under these Terms.
- Without limiting the foregoing, The Perth Mint may aggregate:
- multiple orders placed by the same Customer;
- multiple orders placed using the same payment method, bank account or funding source; and/or
- multiple orders that otherwise appear connected by timing, pattern or other circumstances in the opinion of The Perth Mint,
including where each individual transaction is below AUD 5,000 but the aggregated total meets or exceeds AUD 5,000.
3.3 Transactions of AUD 5,000 or more
- Full identity verification is required before The Perth Mint accepts, processes, dispatches, releases or settles any order where the total transaction value is AUD 5,000 or more.
- For the purposes of these Terms, identity verification means the Customer must provide, and The Perth Mint must verify to its satisfaction, any identification documents or any other documents required under:
- the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and associated rules (together, the AML/CTF Laws) any other applicable laws and regulations (including as referred to in clause 3.4); and
- The Perth Mint’s onboarding requirements.
- Verification requirements may vary depending on account type, Customer identification or circumstances, product, payment method and applicable legal or regulatory requirements, and may include one or more of the following (as determined by The Perth Mint acting reasonably):
- provision of identification document details (for example, passport or driver’s licence);
- completion of electronic and/or manual identity verification steps;
- provision of certified or notarised copies of identification documents where requested;
- provision of information and/or documents relating to beneficial ownership or authority to transact (including where the Customer is acting as trustee, agent, representative, company officer or otherwise on behalf of another person);
- provision of source-of-funds and/or source-of-wealth information where reasonably required for AML/CTF or risk purposes; and
- for Online Orders or Telephone Orders, completion of any Contract Completion Guarantee (as referred to in clause 5.5) or similar verification step required by The Perth Mint (which may include provision of credit card details).
- The Perth Mint will notify the Customer if identity verification is complete or if further information is required. The Perth Mint may delay processing, dispatch, release or settlement until verification is complete.
3.4 AML/CTF laws and additional verification rights
- The AML/CTF Laws require The Perth Mint to appropriately identify and/or verify customers and, where applicable, beneficial owners before providing certain designated services.
- Regardless of Purchase Method or transaction value, The Perth Mint may require the Customer to provide identification information or documents (including updated or additional information) at any time where reasonably necessary to:
- verify or re-verify the Customer’s identity, authority to transact, or beneficial ownership;
- comply with AML/CTF Laws or other applicable laws, regulatory requirements, directions or guidance; or
- manage fraud, payment, security or operational risk.
- The Perth Mint may refuse, delay, suspend or cancel any Account or order, or refuse to dispatch, release or settle products or payments without having to give reasons, where:
- the required identification information or documents are not provided;
- the Customer’s identity (or authority to transact) cannot be verified to The Perth Mint’s satisfaction;
- The Perth Mint has legitimate concerns regarding the Customer’s ability to comply with applicable legal or regulatory obligations or its risk management systems; or
- the Customer fails to comply with these Terms or The Perth Mint’s onboarding requirements.
- The Customer represents and warrants that it is not a person or entity subject to any applicable sanctions administered or enforced by Australia or any other applicable jurisdiction. The Perth Mint may refuse, suspend or cancel any order or Account where it reasonably believes that completing the transaction would breach any applicable sanctions law.
3.5 Document standards and submission
- Identification information and documents must comply with The Perth Mint’s onboarding forms and requirements published or referred to on its Website.
- Where The Perth Mint requests copies rather than originals, a “certified” or “notarised” copy means a document certified or notarised as a true copy of the original in accordance with applicable law.
- Where identification documents are required to be provided electronically, The Perth Mint will provide a secure upload method (for example ShareFile or another secure portal).
- The Customer must not send identification documents to The Perth Mint by email or post original identification documents by mail.
3.6 Authority, consent and verification
- By providing identification information or documents, the Customer represents and warrants that:
- the Customer is authorised to provide that information; and
- the information is true, accurate and complete.
- The Customer consents to The Perth Mint collecting, using and disclosing personal information (including to third-party service providers) for the purposes of:
- verifying the Customer’s identity and authority to transact;
- administering the Customer’s Account and orders; and
- complying with AML/CTF Laws and other applicable laws.
- The Customer consents to any third-party identity verification provider engaged by The Perth Mint accessing and using personal information about the Customer held by government agencies or other authorities for identity verification purposes.
- Where a Customer’s identity cannot be verified using the information provided, alternative verification methods may be available on request. If identity cannot be verified using any method acceptable to The Perth Mint, The Perth Mint may refuse, delay or cancel the Account or order in accordance with clause 3.4(c).
- The Customer agrees that only after The Perth Mint is satisfied (in its absolute discretion) that proof of the Customer’s identity has been established and the validation procedure has been completed, The Perth Mint will be able to complete the creation of the Customer’s Account.
- The Perth Mint will keep full and proper records of all disclosures, confirmations and consents connected with the Customer’s personal information to the extent required by law and in accordance with The Perth Mint’s legislative obligations.
4. Pricing
4.1 Pricing principles
- Bullion prices are live and updated at regular intervals while the global precious metals market is open. Outside of this period, pricing reflects the last secured market price.
- Displayed prices are indicative retail prices only and do not constitute firm commitments to supply at that price or an offer capable of acceptance by the Customer.
- The Customer acknowledges and agrees that:
- trading in Bullion Products involves inherent market risk and price volatility;
- The Perth Mint does not provide investment, financial or tax advice; and
- the Customer is solely responsible for any investment or trading decision relating to Bullion Products and assumes all risk of price movement following purchase.
4.2 Fixed price
- For Online Orders, the price is fixed when The Perth Mint issues the Order Confirmation under clause 2.3(c).
- For Telephone Orders and In-Store Orders, the price is fixed when The Perth Mint confirms the order details and accepts the order in accordance with clause 2.3(c) or clause 2.4(a).
5. Payment
5.1 Payment requirements and order limits
- The Perth Mint will not dispatch, release or make available any Bullion Products until Cleared Funds for the order have been received in full.
- For Online Orders and Telephone Orders, unless otherwise expressly stated in these Terms, the Customer must ensure that the full order price is received by The Perth Mint in Cleared Funds within two Business Days after receipt of an Order Confirmation.
- Online Orders are limited to a maximum total transaction value of AUD 70,000 (per order). Orders exceeding AUD 70,000 cannot be placed online and must be placed by Telephone Order or In-Store Order.
- Telephone and In-Store Orders may be placed for any value. However, deposit and pre-payment requirements may apply under clause 5.2 depending on the order value.
5.2 Deposit and pre-payment requirements
- In-Store Orders and Telephone Orders with an order value exceeding AUD 150,000 require payment of a deposit equal to fifteen per cent (15%) of the order value in Cleared Funds prior to the fixing of prices and the issue of an Order Confirmation.
- Where the Perth Mint accepts an In-Store Order or Telephone order with an order value exceeding AUD 2,000,000, the full order price must be paid in Cleared Funds prior to the fixing of prices and the issue of an Order Confirmation.
- Notwithstanding the foregoing, The Perth Mint reserves the right to require payment of a deposit or full pre-payment in Cleared Funds prior to the fixing of prices and the issue of an Order Confirmation where The Perth Mint reasonably considers it necessary or appropriate in the circumstances, including for fraud prevention, operational risk management, hedging or market exposure management or regulatory compliance.
5.3 Payment conditions
- All payments must originate from a bank account held in the same name as the Customer, including the name recorded on the Customer’s Account (where applicable). The Perth Mint may reject, return or place on hold any funds received from a third-party account.
- The Perth Mint may reject, return or place on hold any funds received where payment cannot be verified or where doing so is reasonably necessary for fraud prevention, security, operational risk or compliance reasons.
- The Customer must ensure that the full amount payable to The Perth Mint is received in Cleared Funds. All bank fees, intermediary bank charges, foreign exchange costs and other transaction expenses associated with payments to The Perth Mint are borne by the Customer.
- The Perth Mint may request source of funds, source of wealth or other verification information in connection with any payment for the purposes of compliance with applicable laws (including AML/CTF legislation), fraud prevention or internal risk requirements. Failure to provide requested information within a reasonable time may result in delay, suspension or cancellation of the order, return of funds, or refusal to release Bullion Products, subject to applicable law.
5.4 Payment methods
- Accepted payment methods may vary depending on the Purchase Method or order value.
- The Perth Mint may amend accepted payment methods, transaction limits, surcharges and clearing times for operational, regulatory or security reasons.
- The Perth Mint Gift Cards are not redeemable for Bullion Products.
- For Online Orders and Telephone Orders:
- payment may be made by Electronic Funds Transfer (EFT) or BPay;
- credit or debit card payments are accepted up to AUD 5,000 per order (inclusive of any applicable credit card surcharge);
- where payment is made by card, the card will generally be debited within 24 hours after the order is confirmed;
- PayPal payments are accepted; and
- Real Time Gross Settlement payments and telegraphic transfer are not accepted.
- For In-Store Orders:
- EFTPOS, debit cards, credit cards and mobile wallet payments (including Apple Pay, Google Pay and Samsung Pay) are accepted, subject to the following transaction limits and requirements:
- for transactions up to and including AUD 15,000 (exclusive of any applicable surcharge), payment may be made without any additional verification requirements beyond those ordinarily required by the relevant card issuer or payment network;
- for transactions exceeding AUD 15,000 but not exceeding AUD 150,000 (exclusive of any applicable surcharge), additional verification requirements may apply before payment is accepted, including the entry of a PIN; and
- transactions exceeding AUD 150,000 must not be paid by EFTPOS, debit card, credit card or mobile wallet payment and must instead be paid using one of the payment methods referred to in clause 5.4(e)(ii).
Where permitted by law, a surcharge may apply to transactions using the credit facility. No surcharge applies to EFTPOS debit transactions; - EFT payments are accepted. BPAY payments may also be accepted where a biller code and reference number are provided at the time a price is fixed, provided that the Customer provides proof of payment to The Perth Mint upon request;
- the physical debit or credit card displaying the Customer’s name must be presented at the counter; and
- The Perth Mint Shop does not accept payment by cash, cheque, money order, buy now pay later providers, international currencies, cryptocurrencies or other alternative currencies, or payments made by third parties.
- EFTPOS, debit cards, credit cards and mobile wallet payments (including Apple Pay, Google Pay and Samsung Pay) are accepted, subject to the following transaction limits and requirements:
5.5 Contract completion guarantee and card security (online orders)
- As a condition of registering for and maintaining an online Account, the Customer must provide valid credit or debit card details in the name of the Customer (a Registered Card).
- The Registered Card operates as a contract completion and fraud-prevention security for Online Orders and does not constitute payment for Bullion Products unless separately used as a payment method under clause 5.4(d).
- A $0 pre-authorisation is a validation of the Registered Card and is an indication to The Perth Mint that prior to the acceptance of an order placed by the Customer and fixing of the price by The Perth Mint, the Registered Card will accept charges from The Perth Mint.
- A successful pre-authorisation of a Registered Card is a condition to acceptance of an Online Order and price fixing under clause 2.3(c) and clause 4.2(a).
- If the Customer fails to complete an accepted Online Order in accordance with clause 5.1, The Perth Mint may charge to the Registered Card any reasonable losses directly incurred by The Perth Mint as a result of the non-completion, including payment processing costs and hedging or market movement losses, to the extent permitted by law.
- Except as provided under clause 5.5(e), for payment of shipping or related charges where Bullion Products are dispatched due to the Customer failing to collect them, or where the Registered Card is used by the Customer as a payment method under clause 5.4(d), the Registered Card will not be charged for any other purpose.
- The Customer must ensure that the Registered Card remains current, valid and in the Customer’s name while any Online Order remains open or capable of acceptance. Failure to maintain a valid Registered Card may result in refusal or cancellation of Online Orders.
5.6 Non-payment or late payment
- If Cleared Funds are not received within the timeframe required under clause 5.1, The Perth Mint may, without liability to the Customer:
- cancel or refuse the order; and/or
- suspend or refuse further orders from the Customer.
- Where an order is cancelled or not accepted due to non-payment or late payment, The Perth Mint may recover from the Customer its reasonable administrative costs and any losses directly caused by the non-payment or delay, to the extent permitted by law.
- The Customer acknowledges that bullion transactions are subject to market volatility and that late or failed payment may expose The Perth Mint to market risk and hedging costs.
- Nothing in this clause limits any rights or remedies available to The Perth Mint under these Terms or at law in respect of market risk, price movement or default by the Customer.
6. Title and risk
- Title to the Bullion Products remains with The Perth Mint until full payment of the relevant order has been received in Cleared Funds.
- Risk in the Bullion Products passes to the Customer upon:
- delivery being recorded by the carrier, except where the Customer has declined shipment coverage under clause 8(d), in which case risk passes on dispatch; or
- collection by the Customer. If the Customer fails to collect ordered Products within the required Collection Period (defined in clause 7.8(e)), risk in the Bullion Products passes to the Customer on dispatch.
- The Perth Mint may refuse to dispatch or release Bullion Products where any legal, regulatory, payment, identification, security or operational requirement under these Terms has not been satisfied.
7. Shipping and delivery
7.1 General
- Delivery timeframes and logistics are subject to bullion market conditions, production capacity, security requirements, carrier availability and any logistics or operational notices published on the Website.
- Any delivery timeframes provided by The Perth Mint or a carrier are estimates only and are not guarantees. The Perth Mint is not liable for delays caused by carriers, customs authorities or events beyond The Perth Mint’s reasonable control.
- For freight calculation purposes, the packed weight of an order is deemed to be the product weight plus 20% for packaging. Freight charges are payable by the Customer and calculated on that deemed packed weight and are not adjusted or refunded if the actual freight cost incurred is lower.
- The Customer must provide accurate and complete delivery details at the time of order. If delivery details are incomplete or incorrect, The Perth Mint may be required to delay dispatch, re-direct the shipment to a carrier depot for collection or incur additional charges (including return or re-delivery charges), which will be payable by the Customer.
- In the case of residential or commercial addresses, the Customer must ensure that an adult person is present at the Customer’s nominated delivery address to receive the order at the time of delivery.
- The Perth Mint may select or change carriers at its discretion without prior notice to the Customer.
- Delivery is deemed to be completed when the carrier records delivery to the Customer’s nominated delivery address, unless the Customer proves otherwise.
- Any claim for non-delivery, missing items or loss in transit must be made promptly and in any event within 14 days after The Perth Mint records dispatch (or such longer period as may be required by the ACL), by giving written notice to the Online Orders team via the Customer Care page on the Website. Each claim will be assessed on a case-by-case basis, and The Perth Mint may investigate the claim as it considers appropriate (including engaging the carrier and requesting information from the Customer).
- The Customer must provide any information and supporting documentation reasonably requested by The Perth Mint to assist in investigating a delivery claim.
- The Perth Mint will not accept a claim for a “lost” or “missing” parcel where the Customer has not complied with these Terms, not provided accurate or complete delivery details, or where the Customer’s act or omission materially compromises The Perth Mint’s ability to verify delivery.
7.2 Dispatch
- Orders are dispatched from The Perth Mint during Western Australian business hours, and expected dispatch dates and times are estimates only and are not binding.
- Dispatch is subject to receipt of Cleared Funds and completion of all identification and security requirements.
- Dispatch timeframes are indicative only and may be extended where reasonably necessary due to:
- abnormal or extreme bullion market demand;
- production constraints or stock shortages;
- supply chain or logistics disruption;
- security or regulatory requirements; or
- Force Majeure or events beyond The Perth Mint’s reasonable control.
- On the day of dispatch from The Perth Mint premises, an email will be sent to the Customer’s nominated email address advising the shipping and tracking information.
- Delays arising from the circumstances in clause 7.2(c) do not constitute breach or failure to supply by The Perth Mint.
7.3 Australian shipments – under AUD 70,000
- Australian shipments with an order value under AUD 70,000 are generally delivered by standard carriers to most Australian residential and business addresses. Some remote locations may require collection from the nearest carrier depot.
- Delivery normally occurs within 1-3 days after dispatch, but may take longer depending on location, carrier conditions, holiday periods or other reasons beyond The Perth Mint’s reasonable If the Customer is unavailable to receive delivery, the carrier will provide information regarding collection or re-delivery in accordance with the carrier’s procedures.
7.4 Australian shipments - over AUD 70,000
- Australian shipments with an order value of AUD 70,000 and above require enhanced security arrangements. The Online Orders team will liaise with the Customer to confirm delivery requirements and provide a specific freight quote and shipping instructions.
- Orders of AUD 70,000 and above may only be:
- delivered to a verified business addresses approved in advance; and/or
- made available for collection from a carrier depot or secure facility,
for security and risk reasons, as determined by The Perth Mint and/or the carrier. - The Customer may be required to present photographic identification at delivery or collection, and to comply with any carrier security requirements.
- Carriers reserve the right to decline a delivery where the delivery address is assessed as a high-risk area or where the carrier’s security requirements cannot be met. In such cases, The Perth Mint may arrange an alternative delivery method or depot collection.
7.5 International shipments and deliveries – under AUD 30,000
- International shipments with an order value under AUD 30,000 are generally delivered by standard carriers to most overseas addresses, subject to carrier network availability and destination restrictions. Shipments to certain regions may also be subject to maximum shipment value limits imposed by carriers, insurers or local regulations. These limits vary by destination and may change from time to time.
- If no person is available to receive delivery, the carrier may leave a card or notification for the Customer to arrange a re-delivery or collection of the item within the carrier’s specified timeframe. If the Customer does not arrange re-delivery or collection with that timeframe and the shipment is returned to The Perth Mint, the Customer must pay all return freight fees and any associated government or carrier charges. Additional fees will apply for re-delivery.
- Shipping to certain international destinations is contingent on arrangements between The Perth Mint and its preferred service provider for that region and may be unavailable or subject to additional conditions from time to time.
- The Perth Mint may refuse or restrict shipments to certain jurisdictions where export restrictions, sanctions laws or carrier restrictions apply.
7.6 International shipments and deliveries – over AUD 30,000
- International shipments with an order value of AUD 30,000 and above require a secure carrier and enhanced security arrangements. The Online Orders team will liaise with the Customer to confirm delivery requirements and provide a specific freight quote and shipping instructions.
- The Perth Mint requires delivery to a verified business address or depot collection. The Perth Mint may require additional identity and security steps as a condition of shipment, depending on the destination, carrier requirements and risk assessment.
- Shipments to certain regions may also be subject to maximum shipment value limits imposed by carriers, insurers or local regulations. These limits vary by destination and may change from time to time. Where applicable, The Perth Mint will notify the Customer if a proposed shipment exceeds the applicable limit and alternative delivery arrangements may be required.
- The Perth Mint may refuse or restrict shipments to certain jurisdictions where export restrictions, sanctions laws or carrier restrictions apply.
7.7 International import charges and taxes
- Prices do not include overseas customs duties, foreign taxes, import VAT/GST, customs brokerage fees, additional clearance charges or any other costs associated with importation or local customs clearance.
- These amounts are the sole responsibility of the Customer, including obtaining any import licences (if required) and providing any information required by local authorities for formal customs clearance in the country of destination.
- The Customer is required to check with the relevant local customs office prior to placing any order to confirm applicable duties, taxes, restrictions and clearance requirements.
- If the Customer refuses or fails to provide the required customs documentation, or delivery is refused due to duties, taxes or fees and the shipment is returned to The Perth Mint, all costs associated with the return (including freight, customs and carrier fees) will be borne by the Customer.
7.8 Click and Collect
- The Perth Mint’s Click and Collect service may be available for Telephone Orders and Online Orders, in accordance with these Terms. Where a Customer elects to use this service when placing an order, the terms of this clause 7.8 shall apply.
- Once the Customer’s ordered Bullion Products are in stock and have been packaged for collection, The Perth Mint will issue the Customer an email notifying the Customer that ordered Bullion Products are ready to collect (Ready to Collect).
- Orders for in-stock Products are generally available to collect within 3 – 5 Business Days after full payment of the relevant order has been successfully processed and received by The Perth Mint in Cleared Funds. Collection timeframes are estimates only and not binding, and may be extended where reasonably necessary due to production constraints or stock shortages, abnormal or extreme demand, operational or security requirements, system outages, or events beyond The Perth Mint’s reasonable control, including during peak trading periods.
- Collection is available at The Perth Mint Shop during The Perth Mint’s published open hours.
- Orders for collection will be held by The Perth Mint for 14 days from the date the Ready to Collect email is issued to the Customer (Collection Period). If the Customer is unable to collect the order within this Collection Period, the Customer must contact the Online Orders team via the Customer Care page on the Website to discuss alternative arrangements.
- Orders must be collected in person and only by the individual whose name appears on the Order. For security and verification purposes, The Perth Mint does not permit collection by alternate individuals or third parties.
- Upon collection of the Customer’s order at The Perth Mint Shop:
- the Customer will be required to present the following documents:
- the Ready to Collect email (digital or printed); and
- a valid government-issued photo identification (such as a driver's licence or passport) that matches the name on the Customer’s order; and
- the Customer will be required to sign an acknowledgement or proof of receipt confirming that the order has been collected.
- the Customer will be required to present the following documents:
- The Perth Mint reserves the right to refuse the release of any ordered Bullion Products if a Customer is unable to provide the required identification documents in accordance with clause 7.8(g)(i)(B) at the time of collection.
- The Perth Mint reserves the right to cancel all or any part of an order without any liability if the Customer fails to collect the ordered Bullion Products within the Collection Period set out in clause 7.8(e). In the event of such cancellation, The Perth Mint will dispatch the Bullion Product(s) to the Customer’s nominated delivery address at an extra cost to the Customer (including applicable shipping charges and non-optional shipment coverage applied at the rate of 1.1% of the value of the Bullion Product(s) shipped). Refer to The Perth Mint’s Shipping and Delivery Costs page on the Website for more information. For the avoidance of doubt, orders for Bullion Products cannot be cancelled by Customers.
- The Customer is responsible for any additional shipping and handling costs resulting from the Customer’s failure to collect the ordered Bullion Products within the Collection Period.
8. Optional shipment coverage
- The Perth Mint offers shipment coverage on payment of an optional fee.
- The Customer agrees that delivery arranged using a secure carrier includes insurance, and the Customer must comply with any carrier security requirements.
- If the Customer declines the optional shipment coverage offered by The Perth Mint, the Customer must:
- for Online orders, deselect the Bullion shipment coverage option and complete the applicable liability acceptance steps during checkout; or
- for Telephone Orders, sign and return a Shipment Liability Waiver form.
- If the Customer declines the optional shipment coverage offered by The Perth Mint, risk in the Bullion Products passes to the Customer when the Bullion Products are dispatched to the carrier, to the extent permitted by law, and the Customer is responsible for arranging any separate coverage the Customer requires.
9. Limitation of liability
- To the maximum extent permitted by law, and subject to clause 1.2, The Perth Mint’s total aggregate liability to the Customer arising out of or in connection with the supply, non-supply or delay in supply of Bullion Products, or otherwise arising under or in connection with these Terms (including in contract, tort (including negligence), statute, equity or otherwise), is limited to the amount actually paid by the Customer to The Perth Mint for the relevant Bullion Products giving rise to the claim.
- To the maximum extent permitted by law, The Perth Mint will not be liable to the Customer for any indirect, incidental, special, consequential, punitive or exemplary loss or damage of any kind, including (without limitation):
- loss of profits, revenue, opportunity or anticipated savings;
- loss of investment value or market opportunity arising from bullion price movements;
- loss of business, contracts, reputation or goodwill;
- financing costs or increased procurement or replacement costs;
- loss arising from delay in dispatch, delivery or availability of Bullion Products; or
- loss arising from reliance on any market information, pricing, commentary or material published by or on behalf of The Perth Mint, even if The Perth Mint has been advised of the possibility of such loss or could reasonably have foreseen it.
- Without limiting clauses 9(a) and 9(b), The Perth Mint is not liable for any loss, damage or delay arising directly or indirectly from:
- bullion market volatility, price fluctuations or market suspension;
- production constraints, refining or minting capacity limitations, or raw material shortages;
- security, transport, shipment coverage or other insurance or carrier requirements or restrictions;
- any act or omission of a third-party carrier, logistics provider or security provider involved in the storage, handling or transport of Bullion Products;
- any order suspension, refusal, cancellation or delay permitted under these Terms, including for regulatory, AML/CTF, sanctions, fraud, security or risk-management reasons;
- the Customer’s failure to provide accurate order, delivery, identification or payment information;
- any failure of payment to constitute Cleared Funds; or
- events beyond The Perth Mint’s reasonable control (including Force Majeure).
10. Returns and refunds
- Bullion Products are supplied on a final and non-returnable basis. Except where expressly permitted under these Terms, The Perth Mint does not accept returns or exchanges. This includes, but is not limited to, change of mind or incorrect choice (including due to changes or movements in precious metal prices or market conditions).
- Where delivery of Bullion Products cannot be completed due to the Customer’s act or omission (including refusal to accept delivery, failure to be available to receive delivery, or provision of incorrect or incomplete delivery details) the order will not be treated as a return. Any Bullion Products returned to or held by The Perth Mint in these circumstances remain at the Customer’s risk and expense, including all storage, shipment coverage, insurance, re-delivery and administrative costs incurred by The Perth Mint.
- If Bullion Products are returned to The Perth Mint by a carrier or are otherwise unable to be delivered for reasons attributable to the Customer, The Perth Mint may arrange re-delivery at the Customer’s cost.
11. Australian goods and services tax (GST)
GST is not levied on bullion sold in Australia or overseas. However, Australian domestic sales incur GST on freight. Overseas sales only incur GST if the bullion is not exported within 60 days of the order.
12. Privacy
- Any personal information submitted by the Customer to The Perth Mint is subject to and will be handled in accordance with The Perth Mint’s Privacy Policy set out on the Website.
- The Customer agrees that, by using any Purchase Method to purchase Bullion Products, the Customer has read the Privacy Policy, understood its contents and consented to its requirements.
13. Force majeure
13.1 Definition
Under these Terms, Force Majeure means any act, event or cause that is beyond the reasonable control of The Perth Mint, including but not limited to an act of God, act of any governmental agency, accident of navigation, war (whether declared or not), sabotage, riot, insurrection, civil commotion, national emergency (whether in fact or law), martial law, fire, lightning, flood, earthquake, landslide, storm or other severe weather conditions, explosion, power shortage, strikes, lock-outs or other industrial disturbance (whether or not involving employees of the party concerned), uncontrollable delays in transportation, inability to obtain any necessary equipment, facilities or qualified employees, epidemic, quarantine, radiation or radioactive contamination, cyber incidents, or the effect of any applicable law, orders, rules or regulations.
13.2 Scope
- If The Perth Mint is unable, wholly or in part, to perform any of its obligations under these Terms due to a Force Majeure event:
- The Perth Mint will give the Customer prompt notice of the Force Majeure event and, to the extent reasonably known, the expected extent and duration of the inability or delay in performance;
- the affected obligations of The Perth Mint will be suspended for the period and to the extent they are affected by the Force Majeure event; and
- The Perth Mint will, where possible, resume performance of those affected obligations under these Terms as soon as reasonably practicable after the Force Majeure event ceases to affect performance.
- Nothing in this clause affects any rights or risk allocation expressly set out elsewhere in these Terms.
14. Complaints and dispute resolution
- If the Customer has a complaint in connection with an Order, Bullion Products, delivery or collection (including Click and Collect) or these Terms, the Customer may lodge the complaint by:
- submitting the complaint using the Customer Complaints Form available on the Website; or
- contacting The Perth Mint’s Online Orders team via the Customer Care page on the Website.
- The Perth Mint may request further information reasonably required to investigate and respond to the complaint (including the relevant order reference number, a description of the issue and supporting information). The Perth Mint will acknowledge receipt of the complaint within a reasonable timeframe and will use reasonable endeavours to investigate and respond as promptly as reasonably practicable, having regard to the nature and complexity of the complaint. Where the complaint relates to non-delivery, missing items or loss in transit, the requirements and timeframes in clause 7.1 apply.
- If a dispute arises between the Customer and The Perth Mint in connection with these Terms or an order, the Customer and The Perth Mint must use reasonable endeavours to resolve the dispute. Subject to any urgent requirement for interlocutory or injunctive relief from a court of competent jurisdiction, the Customer and The Perth Mint agree to first attempt to resolve the dispute through the complaint process set out in this clause before commencing court proceedings or any other formal dispute resolution process.
15. Severability, entire agreement
- If any provision of these Terms becomes invalid by law, regulation or proceeding, all other provisions remain in full force and effect.
- These Terms constitute the entire agreement between the Customer and The Perth Mint with respect to the transaction contemplated in these Terms and supersedes and extinguishes all prior oral agreements and understandings between the Customer and The Perth Mint with respect to the transaction.
16. Governing law and jurisdiction
- These Terms are governed by the laws of the State of Western Australia and applicable laws of the Commonwealth of Australia.
- The Customer and The Perth Mint submit to the non-exclusive jurisdiction of the courts of that State and courts which hear appeals in those courts.
17. Variation
- The Perth Mint may amend or vary these Terms from time to time, by publishing an updated version on the Website. The Perth Mint recommends that the Customer review the Terms prior to placing an order to ensure awareness of the terms applying at that time.
- The Terms that apply to the Customer’s order are those in force at the time the Customer submits its order.
18. Waivers and remedies cumulative
- No failure to exercise and no delay in exercising any right power or remedy under these Terms shall operate as a waiver, nor shall any single or partial exercise of any right, power or remedy preclude any other or further exercise of that or any other right, power or remedy.
- The rights, powers and remedies provided to The Perth Mint under these Terms are cumulative and are not exclusive of any rights, powers or remedies provided by law.
